practicing homeopathy in USA

Can Homeopaths from USA give the details on "License to practice"
homeopathy in each of the 50 States in USA especially for a person
who had H-1 visa and practical experience for a decade in India
having RMP certificate and 12 years of experience.

The information I gathered is as follows. (It may be useful for the
needy)

1) Homeopathic medicines (drugs) in the USA are recognized under
the 1938 Food, Drug and Cosmetic Act and, therefore, come under the
regulatory purview of the US FDA at the national or federal level.

2) The practice of medicine, whether allopathic or homeopathic, is
regulated by the individual fifty states via their respective Medical
Licensing Boards. . To find out what these requirements are for a
particular state, contact the State Attorney General's Office in the
capital city of that state. Link to all state medical boards is

FSMB ,Federation of state medical boards says

A. The definition of the practice of medicine should include
using the designation Doctor, Doctor of Medicine, Doctor of
Osteopathy, Physician, Surgeon,Physician and Surgeon, Dr., M.D., D.O.
or any combination thereof in the conduct of any occupation or
profession pertaining to the prevention, diagnosis or treatment of
human disease or condition unless such a designation additionally
contains the description of another branch of the healing arts for
which one holds a valid license in the jurisdiction.

B. The medical practice act shall not apply to

i. students while engaged in training in a medical school approved by
the state medical board;

ii. those providing service in cases of emergency where no fee or
other consideration is contemplated, charged or received;

iii. commissioned medical officers of the armed forces of the United
States and medical officers of the United States Public Health
Service or the Veterans Administration of the United States in the
discharge of their official duties and/or within federally controlled
facilities, provided that such persons who hold medical licenses in
the jurisdiction should be subject to the provisions of the act and
provided that all such persons should be fully licensed to practice
medicine in one or more jurisdictions of the United States;

iv. those practicing dentistry, nursing, optometry, podiatry,
psychology or any other of the healing arts in accord with and as
provided by the laws of the jurisdiction;

v. those practicing the tenets of a religion or ministering to the
sick or suffering by mental or spiritual means in accord with such
tenets, provided that no person should be exempt from the public
health laws of the jurisdiction or the federal government;

3) The certification offered by NASH, CHC, HANP, ABHt etc in USA is
not a license to practice homeopathy and certificate holder is not be
eligible to be called a physician or to diagnose or treat as such.
Licenses can only be granted by states or provinces.

The homeopathic certification IN USA is given by -
•DHt -Diplomate in Homeotherapeutics by the American Board of
Homeotherapeutics http://www.homeopathyusa.org/specialtyboard/
•for NDs, (Doctors of Naturopathy), DHANP-Diplomate of the
Homeopathic Academy of Naturopathic Physicians Offering board
certification in classical homeopathy to qualified naturopathic
physicians. http://www.hanp.net/
•for CCH any licensed health professional Certified by the (Council
on Homeopathic Certification), www.homeopathicdirectory.com
• for RSHom (NA) anyone who completes a recognized school of
homeopathy (Registered by North American Society of Homeopaths,
NASH). http://www.homeopathy.org/

4) Currently, only the states of Arizona, Connecticut, and Nevada
have separate licensing boards for medical physicians who practice
homeopathy. Some individuals in the United States practice
homeopathy, without a medical degree. This is regulated separately in
each state. A person should research hoping to practice in a
particular state. Even though I read details in websites of
different state medical boards, i could not understand anything.

5) To practice homeopathy in a state we may need to consult a
licensed homoeo professional to know the detials.

6) Those who have certificate and do not happen to be licensed to
practice homeopathy will have to ensure that their clients have been
made aware of the status of homeopathic practice in that state or
province.

My queries are
1) Is the License to practice homeopathy compulsory in most of the
states for Homeopaths
2) Is there any state where license is not required? Or is there any
way to do practice without it.
3) Can Homeopaths from different states of USA( Take this
opportunity to provide the details on "License to practice
homeopathy" in their State
4) What is the importance of certificates issued by NASH, CHC, HANP,
ABHtare they recognized in any state. Which one is better for the
novice.
5) what is the fate of a person who comes to USA on H-1 visa to
practice homeopathy in USA
6) why can't all these different orgs come under one umbrella and Do
something.
7) CHC sasy " in the dozen or so states that license naturopathic
Physicians (ND or NMD), homeopathy is included within their scope Of
practice". What are these states?

I don't have much time at the moment, but...........
NO license is needed to practice except in states that require you to be an
MD or associated with one (Arizona and Nevada are 2 - may be more)

Homeopathy is basically not legal nor is it illegal in many states
Nearly every state people practice without a license
You have to look at each state
Health Freedom Acts help you to practice in California and Minnesota to name 2
They are not necessary to practice in any state
can't answer that
Many of us who have been around a long time do NOT want licensure of
homeopaths for many reasons

WA state an "Advanced Registered Nurse Practitioner" (ARNP) is
considered a physician and may prescribe, but not in Florida.
Yes - but look at the letter of the law yourself, do not rely on someone
else. YOU have to show (if challenged) that you follow the law... and
what you interpret from what someone else interprets - does not count.

This definition varies a lot from state to state.
Who is called a physician varies - and what is considered practice of
medicine also varies. For example in some states prophylaxis is allowed
only by a physician - but in others (including WA) prophylaxis my be
allowed by non-physicians.
It's also important how you define YOUR work. Do you "treat disease -
implying you also diagnose it" (which is not legal in most states) or do
you "build health of the entire individual" which is legal in most
states. Is it the disease you worry about? That's practice of medicine -
finding "Drugs for diseases".
Again you need to check individual states.
Not usually true unless you are under a physician's guidance and HE is
the one technically practising medicine.

The Good Samaritan act varies and only allows that you save life. It's
your job to prove life would have been lost.....
Can't comment...I do not know this area.
Again it is individual by state as to what professions are recognized
and what the recognized ones may do in that state.
There is no official certification in USA.
There are various organisations that have set themselves uip to offer
something they call certification - but there is no state authorized
certification.
You could set yourself up to do it too - or so could I.
It's not official.
This changes frequently - what state allows whom to do which.
There's no such thing as a licencing of homeopaths in USA.
You can consult a homeopath but this will only give you a second-hand
interpretation as opposed to going to the law books.
Not necessarily. every state is different on these rules.
In WA for example there is no rule that I tell anyone anything - but to
be smart I give my clients my credentials in writing up front, plus a
statement of what I do that is legal in WA and what I do not do due to
WA law.
There is no such thing as a homeopath getting a license to practice.
(Tehre may be a few states where this is starting to change.) I have no
license to practise anything - not medicine not homeopathy not flower
gardening.
None recognised by any state.
What's an H-1 visa?
They are making money?
None has offered me what I need. I will join one when it does.
WA is one - I do not know the others.

Two small (possible) hints for your specific case.

It seems that H1 visa are only valid for working in the job the visa
was given for. Maximum time of staying in the USA 6 years. It is
possible to change it to a "green card" sometimes, but that would have
to be applied for by the institute etc. the person works for - which
would mean staying in that job at least until after he got the green
card. Once on green card status s/he should IMO be at liberty to work
in the USA same as any US citicen.(The information is from googling
for H1B visa)

In the State of Colorado it used to be that you could get a licensce
as ND if you could show evidence of courses in Germany equivalent to
those taken in the USA that would qualify you for the ND. That,
however, was almost 20 years ago - I have no idea whether it has
changed.

The "green card" is actually blue these days - but it is what everyone
calls "permanent resident status" and you are right that it gives the

Not quite: One can apply as an individual, it's what I did.
However IF the job place asks for an employee, they can get a preference
status as a sponsor of a new immigrant if they offer to sponsor.

...depends what contract was signed.
If one applies as an individual and has reasons to immigrate considered
valid - then one also gets a work permit each 6 months even before the
permanent residence (green card) is processed.
