Dear folks,

My estimate is that it is about halfway now with the legal situation I am in. The case schedule has deadlines through 25 November to meet, and they are taking a toll on my health to say the least. Last week was especially bad, I have a worsening heart problem to do with the right side not getting current to beat. Makes one feel incredibly weak.
Now I know what "half-hearted" really feels like:-)

I can not discuss details of the case till after the final date (currently set for end of November). There have been obstacles to overcome to meet deadlines of "yesterday". My lawyer has helped me understand things, a huge learning curve, I've never been in a comparable position before, it is Greek to me. And so far we just made each deadline.

Many people sent me helpful financial assistance, and I am so thankful, as with all the funds I could get from my house/credit, it has gotten me this far. I only just managed to pay the last legal bill though and I am tapped out.

The main hearing is scheduled for end November, and thankfully it has been negotiated to take place in Spokane and not Seattle - due to my health being unsuited for travel. That will cost a bit, but it is at least do-able physically for me.

So, thank you all for your support to help me to date, and for any additional support you might please be able to spare at this stage to help with the second half. irene -- have you been in touch with NCH? a few years back they had a legal defense fund tho i do not know its status at present. have you talked with them?

I am sorry to hear that you are having problems in Washington state. I don't understand why you should be having problems. It seems that someone with a little background in this could sit down with the prosecutor and work out some sort of compromise or explanation, as Dana Ullman did, explained below, and get them to drop the charges and stop wasting everyone's time.
Technically homeopaths do not treat disease, nor should they, nor do they need to, whether they are licensed physicians or not. It is enough to say that you as a homeopath are strengthening the vital or spiritual force. In your neighboring state of Oregon, as in many states, homeopathy is reg'd under naturopathy in which an exception is made for religious or spiritual practitioners. Hahnemann likened the phenomenon to Mesmerism, which is essentially direct manipulation or provocation of the vital force. I'd tell them I was practicing my religion and offer the prosecutor and judge a treatment.
There are a couple of people I know who have either gone though this problem or studied it. You may know Dana Ullman in CA, who has written an article on how to practice as a lay homeopath. He writes

The Foundation for the Advancedment of Innovative Medicine keeps track of states that have regulations that protect patient access to alternative therapies .

The argument that practicing homeopathy is not practicing medicine is faulty especially if the state has had a homeopathic medical licensing law in the past, usually around the early 1900s. Without education or practice standards the only grounds of prosecution is fraud or abuse. Minnesota�s health department compiled a favorable report on alternative and complementary medicine which stated:

�Creative alternatives should be sought wherever possible. Regulation should interfere as little as possible. If regulation is necessary, the least restrictive regulation should be used � It should not restrict if there is no risk of personal safety.�

The only professions that are allowed to diagnose and treat illness in all states are medical doctors (MDs) and osteopathic doctors (DOs). Several states license naturopathic physicians (NDs) to diagnose and treat illness (AK, AZ, CT, HI, ME, MT, NH, OR, UT, VT, WA). Other health-care providers such as nurse practitioners, physician assistants, dentists, veterinarians, chiropractors, licensed acupuncturists, nurse midwives, and podiatrists may be allowed to use homeopathy within the scope of their licenses, depending on the laws of the state in which they reside.

Strengthening the vitality of the person is fine to say and many people will say they strengthen the immune system as this is a more marketable stance. Thanks for the ideas. I have done all that to no effect. I do not do anything which can be called the practice of veterinary medicine, and in 2003, they (veterinarian Goldman in CT, and head of AVMA there, and who is the quackbuster type, full of lies, and also responsible for the recent motion to AVMA to declare homeopathy completely ineffective - made anonymously by him, but I outed him) accused me of practicing veterinary medicine without a license and I explained how it really was. But now there seems to be an escalating level of alternative health practitioner harassment notwithstanding the actual statutes or the actual activities undertaken by the person.

Quackbuster activity is rife, and includes things like distribution to State Boards, of a "Training Manual for Alternative Medicine Prosecutions," and emphasis on going viciously, such as after those with no funds to fight back. I'm in that group, disabled with an SSI income. CA State Board as an example, requires a high school education to be on the state board. The quackbuster five part plan (devised at the Chicago meeting "to stop health fraud", which was perverted from Janet Reno's and the Justice Dept's official fraud definition involving "Over billing, false coding, MD kickbacks, etc.." to one of criminalizing alternative health, goes like this: (1) Set up a central propaganda center. (2) Control who gets prosecuted through the FSMB (Federation of States Medical Boards), and State medical boards. (3) Affect Medicare, and Medical Insurance Company payment decisions (4) Use the system to harass, discourage, and destroy Alt Med practitioners, and providers. (5) Demoralize the opposition with the viciousness of the campaign.
With my own case being sub judice at present, and ongoing with dates till at least end November, I can not give any details on my case. The toll on my almost non-exitent health due to Cushing's syndrome, is no fun. I do appreciate all the support I get from others in the homeopathy community, and without which I'd have no ability to handle this.
