Legal Bid to Save NHS Homeopathy in Scotland

Dear Homeopathy Supporters,

The great news is that lawyers are preparing a Judicial Review of NHS Lothian's decision to stop funding homeopathic services. Earlier this year there was an outrage when it was announced that Lothian would no longer pay for NHS homeopathy, following a review and consultation. NHS Highland had already stopped funding it.

The legal challenge to the NHS Lothian decision has been brought by a patient who started homeopathic treatment in 2002. The decision is to be challenged in the Court of Session, after the patient contacted solicitors Drummond Miller with concerns about the way the review was carried out and its long term effect on those who use the services.

Solicitor Cameron Fyfe is now in the process of securing legal aid, so that the Judicial Review process can begin, which could have a significant effect on other NHS Boards who plan to drop homeopathy. He said he had a strong supportive opinion from Counsel and in the meantime would seek interim interdict against NHS Lothian for closing the service.

Questions have been raised about the way the consultation and review of homeopathy was conducted by NHS Lothian and the lawyers will say that it gathered insufficient evidence, being in breach of the Public Sector Equality Duty which applies under the Equality Act.

The British Homeopathic Association is also critical of NHS Lothian's consultation and said that it failed to properly review and weigh patient feedback from public meetings and written responses, placing too much importance on an online survey. They say that the long term financial effect has not been taken into account, as patients with chronic health problems will be now be forced to seek expensive drugs and treatments.

Note that NHS Greater Glasgow & Clyde is still funding the Glasgow Homeopathic Hospital but the effect of this Judicial Review will be a wake up call for all Scottish NHS Boards who have either cut homeopathic services or are planning to do so.

Please continue to forward the Petition to as many people as possible! After the last email update we moved from 13,000 signatures to nearly 18,000, which was a wonderful response! The Petition serves to show the legislators the great popularity of homeopathy, so the more signatures we get, the better! Thank you for your help.
