A Letter From Fran Sheffield

Today I will be in court - the Federal Court of Australia.

By the end of today I may no longer be allowed to speak or write on the homeopathic treatment and prevention of whooping cough. Why would this be?

On the 18th February 2013, I received two emails with letters attached from Lauren White, Assistant Director of the Enforcement Operations of the Australian Competition and Consumer Commission (ACCC). One was to the company Homeopathy Plus Australia Pty Ltd of which I am a Director and the other was to me personally as a registrant of the Homeopathy Plus website domain name.

We were advised by Ms White that two pages on our website that referred to whooping cough, the whooping cough vaccine, and the homeopathic treatment and prevention of whooping cough contained potentially misleading and deceptive statements. One of those pages was not in the public domain but in a private members’ area.

The letters also referred to prior concerns about a third page that was no longer on the website. That page also spoke about homeopathy and whooping cough but had been removed in April 2012 to allay the concerns of the ACCC. At the time we believed the matter to be resolved, but this was apparently not so as it too was resurrected as a basis for action; Ms White’s letter advised that the ACCC would seek orders regarding these three pages for:

§ 1. Declarations;

§ 2. Injunctions (including an interlocutory injunction);

§ 3. Pecuniary penalties; and

§ 4. Costs.
We were told the ACCC would consider settling this matter by consent if we did not contest liability and agreed to the orders sought by the ACCC. This was something Homeopathy Plus and I could not do because we fundamentally still believe the information we supplied to be correct.

Two days later we received another email advising that a date had been set for a fast-tracked Directions Hearing at the Federal Court of Australia (Sydney) in which the above “relief” points would be sought.

So, today, I find myself in court.

What was so shocking and misleading in those pages that led the ACCC to take such action? The following paragraphs are those identified by the ACCC as responsible:

“Most developed countries are currently in the grip of the whooping cough epidemic. To stop its spread, health officials are calling for the vaccination of adults as well as children. But is large-scale vaccination the best solution? Not only is protection from the current vaccine short-lived and unreliable, but side-effects are common. Recent research also suggests that the bacterium has mutated to a strain against which the vaccine is no longer effective. The homeopathic approach to this problem offers a safe and sensible solution. Homeopathy has a 200 year history of treating and preventing whooping cough without the risk of dangerous side-effects. It can also be used as a 2nd line of defence should vaccine from whooping cough already have been given.” (This page has not been on the website since April 2012).

“Many of those affected by whooping cough have already been vaccinated. Recent studies show that the vaccine has limited effect. To stop the spread of the current epidemic, health officials are calling for the vaccination of adults as well as children. Perhaps it is time to revisit Homeopathy – Homeopaths certainly think so. Homeopathy offers an alternative or ancillary approach to whooping cough management. It is been used by medical and non-medical Homeopaths during the past 200 years for that purpose and has an excellent safety record."

Government Data Shows Whooping Cough Vaccine a Failure.

Australia, along with other countries, has seen a meteoric rise in the number of notified cases of whooping cough in the past few years. Lack of vaccination is often blamed but now information from the Australian government shows that the whooping cough vaccine has been largely ineffective. Between 2008 and 2010, of children aged 0-4 years whose vaccination status was known and who had contracted whooping cough, 75% were fully vaccinated and a further 14% were partly vaccinated. Only 11% were un-vaccinated. Why was the Australian government so slow to release this information? Do records from other countries show this vaccine has been equally unsuccessful? What is the future recommendation from government about whooping cough prevention? In the absence of an effective vaccine for this dangerous disease, it is also wise to know about homeopathy and whooping cough.

Fran, please let us know how this goes for you. We all have a stake in the results, and unfortunately you seem to be the test case. They want to stop you before all of the facts about those vaccines come out, you seem to be the test dummy, if they can stop you the rest of us will be too afraid to say anything.
Please set up some kind of 'defense fund', I for one will send you some money to help defray your legal fees - you are fighting for truth and for homeopathy so why should you fight alone and without help? There must be an appeal process in Australia?

Australia, because of the strong septic voice, I mean 'skeptic' voice, has become a dictatorial country. AVN - Australian Vaccination Network, headed till recently by Meryl Dorey, has gone through hell these last few years with similar persecution. A few loud voices (probably paid for by pHARMa are opposing any information they don't agree with. In Meryl's case, they threatened her children too.

We are all fighting for our existence here in Australia – firstly Fran and this spuri=ous claim – God help you if you question vaccination in this country. And now that they have managed to link the vaccination debate with homeopathy through Fran I am sure that they are rubbing their hands together with glee – trounce the two at the same time!!
Secondly we are fighting the push here to remove up to 30 alternative therapies Homeopathy being one, from the list of allowable rebate claims from PRIVATE Health insurers (to be decided by our Chief Medical Officer CMO alone – some democracy ay) and thirdly the pointes attack against Homeoathy which comes after – supposedly about safety and efficacy – but actually a witch hunt – it will be decided by the ‘Homeopathy Working committee of which there is not one Homeopath involved in even the discussions and nor will they let our Australian Register of Homeopaths even have representation in any committee that may present information to this working committee which is an off shoot of the National Health and Medical Research Council NHMRC and is headed also by the CMO. The NHMRC had a preliminary paper – leaked a year or so ago in which they were out to declare Homeopathy ‘unethical’ this fight still rages
The professional associations of most of our Alternative and Complementary therapies here have just made submissions re research etc to the CMO

- Round one!! I believe the decisions have been made already and we cannot get media time here – except to trounce people like Fran (and Meryl Dorey)who stand to try and at least put alternative research out there for people to read.
It is an election year here in September – so I hope to try and get Getup or one of those groups to take on this cause and circumvent the media control here but seems that this is going to be problematic also – but there are some other avenues that I am considering taking – however to stick your neck out – beings with it more than just the fear of hate campaigns and threats – look at the AVN (Australian Vaccination Network) site to see a little of what they have been and are going through. The latest being they are not allowed to use the AVN name now as it is ‘misleading to the public’ and they are ‘only putting one side of the debate’ – hmmm funny I thought that was what our government was doing?? Id laugh if it were not so serious!!
Anyway pray for us all this year but particularly Fran at the moment and yes we may need finds to fight this – we are not a big country nor a big population so they just make sure that they can bankrupt you in the courts before you can get heard and gag the media so you cant get heard to get support. We will have to do it through social media – so I am suddenly face with having to look at facebook etc which I never wanted to enter in order to find a way through this.

Prof Frederick Mendelsohn (MB BS, PhD, MD, FRACP)

Professor Frederick Mendelsohn is one of Australia’s most prominent neuroscientists. He graduated from Medicine at the University of Melbourne in 1965 and continued his training as a medical registrar at the Royal Melbourne Hospital subsequently became an honorary physician (1971-1972) and then a senior physician (1977-1996) at the Austin Hospital, Melbourne. He completed his PhD in 1972 and has continued to develop a strong research background with over 295 publications. Professor Peter Brooks is currently Director of the Australian Health Workforce Institute (AHWI). Dr Evelin Tiralongo (BPharm (Hons) PhD GradCertHigherEd)

Dr Tiralongo trained as a German pharmacist and specialises in complementary medicine research and teaching. She holds an Honours Degree in Pharmacognosy (1995), a PhD (2003) in Biochemistry and a Graduate Certificate in Higher Education (2007). Currently she is a senior lecturer at Griffith University’s Pharmacy School. A position she commenced in 2004.

Dr Tiralongo is a member of the Queensland Clinical Trial Network and Griffith University’s newly established Clinical Trials Coordinating Centre. She is also an associate investigator on the NHMRC “Centre of Research Excellence in Nursing Interventions for Hospitalised Patients”.

Dr Tiralongo has extensively published in several areas of the Complementary and Alternative Medicine field, such as biochemistry, molecular biology, pharmacology, clinical pharmacy, as well as natural product chemistry.

In 2010 Dr Tiralongo established, together with a colleague, the “Short Course in Integrative Medicine for Pharmacists”, (http://www.integramedshortcourses.com) which is accredited for Continuous Professional Development credits for pharmacists and is offered as workshops in Australia and New Zealand several times each year. This course provides pharmacy practitioners with additional training in delivering evidence-based Complementary and Alternative Medicines information to their patients and customers.

Declared Conflict of Interest: Dr Tiralongo teaches complementary medicines to undergraduate pharmacy students at Griffith University and as part of a Continued Professional Development (CPD) accredited short course for Pharmacists. Dr Nikolajs Zeps (BSc (Hons), PhD)

Dr Zeps is a PhD scientist involved in translational research in breast, gastrointestinal and gynaecological malignancies. He has recently established a translational research program at St John of God HealthCare which is integrated into clinical care. He is an Adjunct Associate Professor in the School of Surgery at the University of Western Australia and in the Department of Medicine at the University of Notre Dame.

Dr Zeps is also a current member of NHMRC’s Australian Health Ethics Committee and Research Committee and the Office of the Gene Technology Regulator’s Gene Technology Ethics and Community Consultative Committee.

Mr John Stubbs (BA Dip Acct)

Mr Stubbs is Executive Officer of canSpeak is a regular speaker at medical conferences and seminars on cancer advocacy, clinical trials and health related issues. He is a survivor of Leukaemia and an active representative of cancer consumers.

He holds a number of board and committee appointments at both the Commonwealth and state level. He holds degrees in accounting and arts and has 30 years experience in the public and private sectors, including 10 years operating his own management consultancy business. He is an Honorary Associate of the School of Medicine, University of Sydney for his work on clinical trials. Mr Stubbs has contributed to a number of booklets, edited consumer booklets for the Cancer Council and contributed to government policy on cancer, cancer services and the value of consumer involvement.

Mr Stubbs is also a current member of NHMRC’s Australian Health Ethics Committee (AHEC) and Consumer Consultative Group (CCG).

We are all fighting for our existence here in Australia – firstly Fran and this spurious claim – God help you if you question vaccination in this country. And now that they have managed to link the vaccination debate with homeopathy through Fran I am sure that they are rubbing their hands together with glee – trounce the two at the same time!!

Secondly we are fighting the push here to remove up to 30 alternative therapies Homeopathy being one, from the list of allowable rebate claims from PRIVATE Health insurers (to be decided by our Chief Medical Officer CMO alone – some democracy ay) and thirdly the pointes attack against Homeoathy which comes after – supposedly about safety and efficacy – but actually a witch hunt – it will be decided by the ‘Homeopathy Working committee of which there is not one Homeopath involved in even the discussions and nor will they let our Australian Register of Homeopaths even have representation in any committee that may present information to this working committee which is an off shoot of the National Health and Medical Research Council NHMRC and is headed also by the CMO. The NHMRC had a preliminary paper – leaked a year or so ago in which they were out to declare Homeopathy ‘unethical’ this fight still rages

The professional associations of most of our Alternative and Complementary therapies here have just made submissions re research etc to the CMO

- Round one!! I believe the decisions have been made already and we cannot get media time here – except to trounce people like Fran (and Meryl Dorey)who stand to try and at least put alternative research out there for people to read.

It is an election year here in September – so I hope to try and get Getup or one of those groups to take on this cause and circumvent the media control here but seems that this is going to be problematic also – but there are some other avenues that I am considering taking – however to stick your neck out – beings with it more than just the fear of hate campaigns and threats – look at the AVN (Australian Vaccination Network) site to see a little of what they have been and are going through. The latest being they are not allowed to use the AVN name now as it is ‘misleading to the public’ and they are ‘only putting one side of the debate’ – hmmm funny I thought that was what our government was doing?? Id laugh if it were not so serious!!

Anyway pray for us all this year but particularly Fran at the moment and yes we may need finds to fight this – we are not a big country nor a big population so they just make sure that they can bankrupt you in the courts before you can get heard and gag the media so you cant get heard to get support. We will have to do it through social media – so I am suddenly face with having to look at facebook etc which I never wanted to enter in order to find a way through this.

Pauline, thank you for this overview. It's interesting to note the prominent exclusion from the Homeopathy Working Committee of anybody who knows anything about either homoeopathy's principle, its clinical results, or the materials science that overcomes simplistic objections to the supposed irrationality of its adjunctive use of ultramolecular potencies. It invites, doesn't it, curiosity as to who chose such inexpert members for an group with such power as this one appears to have.

Hello everyone,

So sorry for not sharing this with the group earlier and contacting privately some of you whom I know will have more than a passing interesting in this.

To say that things have been frenetic on a number of fronts is putting it mildly.

What is happening is important to us all so I will be sending more info into the group either later today or early tomorrow.
