Would the user be able to purchase an update to a program they do not legally own?
They would not be the legal owner of your program, since Archibel's purchase contract does not give you the right to sell it...

I don’t quite understand what you mean about I “ don’t have the right to sell it”. How can that be? I bought the program only used it a couple of times and had to leave my studies. I have the discs etc here – without the key I cannot work the program on my computer and if I sell it the key would go with all the info and I could no longer use it...so I’m very confused.

Hi Trish,

I totally sympathize... But, I think if you check over the papers (or was it all on-line?) you signed when you made the purchase, you will see the document that Lisa recently sent, as an attachment on her post which I have just re-sent to the list--let me know if it doesn't appear, or if you're not able to open it.

Unfortunately, I think this is standard now... MacRep is the same, and I would guess the others are too, tho I don't know.

You purchase the right for *you yourself* to use the program, but the company still considers it "theirs" and does not grant you the right to sell it.

So the purchaser would not have access to any support services, nor (if I've understood correctly, which you should probably verify) be able to buy any upgrades to the program. (I mean, without first making an initial purchase of the program from Archibel.)

Again, this is only my understanding, from the document Lisa sent and similar ones from other companies, so you might want to check it with Archibel to make sure, or at least make sure that any purchaser is aware of the restrictions, and the limits to their purchase.

I'm sorry to be the bearer of bad news! If you made this expensive purchase without being aware of that provision, somebody carries a... well, you have cause for a grievance against somebody! Because that sort of thing certainly should *not* be slipped "under the mat", but should be an important part of what's explained during the purchase!

Best wishes,
Shannon

It was certainly never explained to me when I purchased RADAR and I have to say that I wouldn't purchase an item under those circumstances. If I had my time over again, and those were the rules that went with RADAR, I would look to use Roger's option: http://www.completedynamics.com This is especially a good choice for students with limited income and no certainty that they will continue on their route in their homeopathic studies.

That is not my statement but there's. The problem would be registering the program and being eligible for the 'discounted' upgrades. They wont service the
Radar 9 version anymore, but will sell a new program at discount at the same level that you now own. Is that clearly written?
As you know, I don't support their position but have no power to force them to change it and they are the keepers of the knowledge for troubleshooting. So
we feel a bit stuck. My belief/understanding, based on my general politcs of our capitalist culture, is that their position is all about selling more product. The
issue of ethics, as we have been discussing, doesn't compute with them since capitalism it antithetical to humanistic ethics.
BTW, I checked your yarn out and it looks great. Can't afford any now, but would you like me to put your site out on a craft list?

People should also remember that this option is available online: http://www.homeoint.org/hidb/kent/repertory.htm I had a go when I first spotted it and it seemed quite good. Not tried it in a long time so don't know whether it has changed at all.

HI Trish,

From what I understand the program is not transferable but didn't the document also say that you can return the discs and key to Radar and they will refund monies to you?...sort of buy it back? Correct me if I'm wrong as I didn't keep the document to reread!

Hi,

I broke my dongle years ago and they replaced it for 100 dollars. No problem. It was stuck in the USB port and I put the laptop in the case without noticing the dongle. The dongle was smashed. Another time, movers packed my computer stuff and the dongle was lost in the confusion of unpacking.

Now I notice there is a disclaimer saying you better insure your dongle. Makes me really scared to travel with a dongle. Losing it appears to be like losing the whole program. It would now take 6000 dollars to replace what I have. I feel like I have a bomb ready to go off. Where do I get insurance for a computer program anyway?

I don't know what is behind this new difficulty. Sheri, you may be making a reasonable move. Homeopathy is not supposed to be so difficult.

Best,
Ellen

In Mac Repertory you can go dongle free, but then you are limited to one computer only; if you need 2 or more computers at different locations, you need to carry your dongle from one to the other.
Many years ago, when I just arrived in NZ, I thought I would be a good Belgian patriot and represent Radar in NZ. So they sent me a free programme, instructional videos and loads of documentation and leaflets, then an invoice for all the advertisement material......when I asked if that was their latest Belgian joke, as I was never warned that I, as a representative of the company, would have to pay for their publicity, Archibel Belgium reacted as if I had insulted them, requested their dongle back and never again talked to me.....
Well, I am still with MacRep.............
Also have a look at Homeoquest, an Australian programme that seems to be pretty good, don't know if they use dongles......should be easy to Google them.....
Joe.
