Friends,
Happy Anniversary to Me!
On May 5th, 1976 (good ole Cinco de Mayo!), I was arrested for
practicing medicine without a license in Oakland, California (where I lived
and practiced homeopathy at the time). The state medical board had heard
about me because a former housemate wrote them a letter saying that I was
practicing homeopathy (which he considered quackery) and that I was "hanging
out with people involved in bioenergetics, yoga, and the like."
Obviously...I was very dangerous. Strangely, this former roommate was a
libertarian (they normally do not even believe in licensing...but sometimes,
people who believe in "science" as their religion make all other politic
beliefs moot when their religion doesn't jive with someone else's.
The trial date was set 10 months later...on April 10, 1977 (they chose
Samuel Hahnemann's birthday!--gotta love that!). But two weeks before the
trial, they agreed to my lawyer's proposal to allow me to practice under two
stipulations:
-- I do not call myself a doctor and I should refer patients to doctors for
diagnosis and treatment of disease (I've never had a problem with that)
-- I use a written contract with my patients in which I clearly stipulate
what my role as a homeopathy is as distinct from that of a medical doctor
(NO PROBLEM!...and my lawyer helped me work out a working contract.
In 1981, I was hired by the California medical board to advise them on a
project that I had recommended to them. They wanted to rewrite the legal
definition of medicine! They created 3 conferences and several forums to
discuss this, and they ultimately recommended my proposal! Shock of shocks!
(Our governor at the time was Jerry Brown, a progressive politician and
student of Zen.) However, a new governor was elected shortly after the
report, and nothing happened with the report...until other picked up the
ball in 2001.
After winning, I decided NOT to practice but to go to the Graduate
School of Public Health at UC Berkeley to get my MPH (might phine homeopath
degree...OR masters in public health). I have not done much practice since
then, even though I won this case, because I've been working on educating
people and health/medical professionals about homeopathy.
And thanks to the work of John Melynchuk and Richard Pitt and others, we
now have a law in California that allows anyone to practice homeopathy. For
