Hi Shannon,

This bill does not change the definition of practicing medicine without a license. It takes the current misdemeanor offense and changes it to a felony.

The problem is that the definition of practicing medicine without a license is so broad that it can be used to prosecute anyone unlicensed who uses the terms "doctor" or "physician" to describe themselves, who purports to "treat" a medical condition or who gives out any substance for the treatment of some medical condition (among other things).

The way I read the law, any unlicensed practitioner can be charged at the state's whim. So it makes one nervous when the state wants to increase the penalty even though fewer than one person each year is charged with the offense in a state of 9 million people.

Only MDs, chiropractors, massage therapists and acupuncturists are licensed in North Carolina.
